Article 1

In accordance with Law of the People’s Republic of China on Medical Practitioners and the Regulations of PRC on Traditional Chinese Medicine, Measure of the People’s Republic of China for Management of Nurses and the relevant measures, the Interim Measures are enacted for the purpose of promoting the management of Chinese TCM health professionals practicing abroad and protecting their legitimate rights.

 

Article 2

SATCM’s Accreditation Center of TCM Physician is responsible for qualification accreditation for TCM physicians (assistant and higher level physicians), physicians of intergraded TCM and western medicine (assistant and higher level physicians), physicians of ethnic medicines (assistant and higher level physicians) TCM pharmacists (technician and higher level) and other TCM professionals and technicians who are working abroad.

 

Article 3

The measures are applicable to

(1) The qualification accreditation for Chinese physicians in the fields of TCM intergraded medicine of TCM and western medicine and ethnic medicines who are practicing abroad;

(2) The qualification accreditation of Chinese TCM pharmacists (technicians) who are practicing abroad;

(3) The qualification accreditation of Chinese TCM nurses who are practicing abroad;

(4) The qualification accreditation of other Chinese TCM practitioners who are working in the other technical field;

 

Article 4

All applicants shall submit the following materials to Accreditation Center of TCM Physicians:

(1) A completed application form;

(2) 2 passport-type photographs taken recently;

(3) A copy of the applicant’s ID card;

(4) (a) Qualification certificate, practice certificate of TCM physicians, integrated medicine of TCM and Western medicine, ethnic medicine (original and duplicate);

  (b) Or technical qualification certificate of TCM physicians, integrated medicine of TCM and Western medicine, ethnic medicine (original and duplicate);

(c) Or qualification certificate, practice certificate of TCM pharmacists (technicians) (original and duplicate);

(d) Or technical qualification certificate of TCM pharmacists (technicians) (original and duplicate);

(e) Or qualification certificate, practice certificate of TCM nurses (original and duplicate);

(f) Or technical qualification certificate of TCM nurses (original and duplicate);

  (g) Or qualification certificate of other TCM practitioners who are working in the other technical field of TCM (original and duplicate);

 

Article 5

An applicant can delegate application to a third party which can be an individual or an unit.  The third party can complete the application process for the applicant with a signed letter of authorization.

 

Article 6

Within 5 working days from the date of receiving the application materials,  the Accreditation Center shall notify the applicant whether or not the application is being accepted and if he application is rejected give explanations should be provided.

 

Article 7

Within 30 work days from the date of receiving the application materials, Accreditation Center of TCM Physicians shall complete the accreditation process.

 

Article 8

Accreditation Center of TCM Physicians will issue qualification accreditation for TCM physicians (assistant and higher level physicians), physicians of intergraded TCM and western medicine (assistant and higher level physicians), physicians of ethnic medicines (assistant and higher level physicians) TCM pharmacists (technician and higher level) and other TCM professionals and technicians

Article 9

If the accreditation is not granted, Accreditation Center shall notify the applicant or the delegated third party and return original copies of all the application materials.

 

Article 10

If the accredited certificate is lost, the certificate holder shall apply for the reissuing of certificate by filling application form and submit the identification materials. application form and provide identification documents. After confirmation, Accreditation Center of TCM Physicians will reissue a new certificate to the certificate holder and make public announcement for the invalidation of the previous certificate.

 

Article 11

If any part of the application materials is found forged, after confirmation, the application will be rejected.

 

Article 12

Accreditation Center of TCM Physicians will cancel any Qualification accreditation that is obtained illegitimately.

 

Article 13

If there is any disagreement about the accreditation result, an applicant can submit question to Accreditation Center of TCM Physicians. And the center will reply the applicant within 10 days from the date of receiving the request.

 

Article 14

Accreditation Center of TCM Physicians will establish a database and provide information for individuals and organizations both at home and abroad. Information security and privacy protection are executed in accordance with relevant state provisions.

Article 15

Qualification accreditation requests from foreign governments, institutions and organizations on  TCM physicians, physicians of intergraded TCM and western medicine, physicians of ethnic medicines  TCM pharmacists (technician) and other TCM professionals and technicians shall be conducted in accordance with the measures.

 

Article 16

Accreditation Certificates are uniformly printed and administrated by SATCM’s Accreditation Center of TCM Physicians, P.R. China.

 

Article 17

The accreditation fee shall comply with the standards of the nation’s commodity price department.

 

Article 18

The measures are also applicable to mainland TCM Physicians, Pharmacists, Nurses, or other practitioners, who are practicing in Hong Kong, Macao and Taiwan regions.

 

Article 19

The power of interpretation of the measures shall be vested in the SATCM, P.R. China.

 

Article 20

The measures come into force as from the date of their promulgation.
